What Is KYC Of Directors?

Director identification number (DIN) is a unique identification number given to a person wanting to be a director or an existing director of a company. MCA guidelines specified that to active the DIN (Director Identification Number), it is mandatory to conduct KYC in respect of each director every year. For Financial year 2019-20 on wards – Every Director who has been allotted DIN on or before the end of the financial year, and whose DIN status is ‘Approved’ including disqualified directors, would mandatorily be required to file form DIR-3 KYC.

In case kyc of directors has not been done in the e-form by 30th September on MCA 21 portal, system will mark DIN as “Deactivated due to non-filing of DIR-3 KYC”.

KYC of directors can be done by filing:

  • DIR 3 KYC web form.

What Is DIR 3 KYC or DIR 3 KYC web form?

As per rules any director who was allotted a DIN by or on 31 March 2018 will have to submit his KYC details to the MCA. But as per recent announcement, it is mandatory for all the directors irrespective of their status as qualified or disqualified. 

Depend on circumstances; directors can do KYC by filing following form:

DIR 3 KYC form: DIR 3 KYC form can be filed in following cases:

  1. This form has to be filed if person has become a director or allotted a DIN (Director Identification Number) first time.
  2. Any person who has been allotted DIN (Director Identification Number) on or before 31st March 2018 and the status of such DIN is ‘Approved’, needs to file DIR-3 KYC form to update KYC details such as Mobile number, email id, address etc.
  3. Any person who has allotted DIN during a financial year has to done kyc on or before 30th September of next financial year, if person fails to do so, deactivated DIN would be activated only by filing DIR 3 KYC form.

DIR 3 KYC form is a full form that needs to be file having directors details and should be digitally signed by CA in practice.

DIR 3 KYC web form: DIR 3 web form needs to file when one time DIR-3 kyc form has been filed and no updating in personal details required by director. Web form is very easy to fill and even don’t require any digital sign by CA.

Due Date Of Filing Roc Form DIR 3 KYC

Every individual who is allotted DIN as on 31st March of a financial year must submit his KYC on or before 30th September of the immediately next financial year.

Penalty For Non-filing Roc Form DIR 3 KYC?

If the DIN holder does not file his annual KYC within the due date of each financial year, such DIN shall be marked as ‘Deactivated due to non-filing of DIR-3 KYC’ and shall remain in such Deactivated status until KYC is done with a fee of Rs.5000.

Further, if Director has filed Form DIR 3 KYC of one year, he can access the web services DIR 3 KYC for the following year.
