Latest gst return filing due dates: April & May 2021

COVID has impacted small business in large scale. To give relaxation from GST compliance, the Department of Revenue has taken several relief measures. Apart from waiver of late fees on GSTR-3B of March. April and May 2021 month, GST council has also brought out relief in respect of pending returns in Form GSTR-3B for the tax periods from July 2017 to April 2021.

A) Relaxation in respect of pending returns in FORM GSTR-3B for the tax period from July, 2017 to April, 2021.

  • Time limit for filing the GSTR-3B for the above tax period is between 01.06.2021 to 31.08.2021.
  • For NIL Return: Late fee is maximum of ₹ 500 per return/- (₹ 250-250 each for CGST & SGST respectively).
  • For others: Late fee is maximum of ₹ 1000/- per return (₹ 500-500 each for CGST & SGST respectively).

B) Reduction in rate of Interest.

As per the provisions of GST, normal rate of interest is charged at 18% per annum, for delayed payment of taxes. GST council has reduced this rate of interest to 9% per annum for the month March, April and May, 2021 after satisfy below conditions:

  • Aggregate turnover upto ₹ 5 crores: GSTR-3B of April, 2021 should be file within 30 days of actual due date ie: till 19th June to avail the relief of reduced interest rate.
  • GSTR-3B of May, 2021 should be file within 15 days of actual due date ie: till 4th July.
  • Aggregate turnover more than ₹ 5 crores: GSTR-3B of May, 2021 should be file within 15 days of actual due date ie: till 4th July to avail the relief of reduced interest rate.

Relief of reduced interest rate would be given, if GSTR-3B is filed within the time limit given above, if GSTR-3B is filed after the extended time limit, rate of interest would be 18% per annum.

C) Extension of GST returns due dates of March, April and May 2021 month.

GST council has extended the due dates of filing of GSTR-3B of March, April and May 2021 for specified number of days. Hence, the late fee is waived off for that extended time period.

Aggregate turnover upto ₹ 5 crores:

March, 2021: GSTR-3B should be file within 60 days of actual due date ie: till 19th June.

April, 2021: GSTR-3B should be file within 45 days of actual due date ie: till 4th July.

May, 2021: GSTR-3B should be file within 30 days of actual due date ie: till 19th July.

“NIL Late fees would be charge, if GSTR-3B is filed within the above due dates.
